Governance and Ethics Policy of SocialMood

Policy Effectiveness Date: Last Updated 4 April 2024

SocialMoodApps.Com and all its sub-pages within the United Arab Emirates territory and all affiliated or partner operators in GCC jurisdictions are referred to below collectively as SocialMood ("SocialMood") for which the below policy is applicable and adherence is strictly complied, whereas, AmanaMode Portal Co. L.L.C is the operator of SocialMood in the United Arab Emirates.

I. Introduction

SocialMood, a leading eCommerce digital goods and app recharge platform, is committed to the highest standards of governance and ethical conduct. This policy outlines the principles and procedures that govern our operations and uphold our legal and ethical responsibilities.

II. Anti-Bribery and Anti-Corruption

SocialMood strictly prohibits bribery and corrupt practices in all forms. Employees and associates must conduct all business dealings transparently and with integrity, adhering to the laws and norms to combat bribery and corruption.

III. Trade Compliance

All transactions conducted by SocialMood will rigorously comply with international trade laws. We will not engage with vendors or partners from countries subject to trade sanctions or embargoes mandated by the international community, including but not limited to those enforced by the United Nations Security Council and those listed from time to time on the United Arab Emirates relevant FATF lists. SocialMood operates with a strict policy that precludes conducting business with any users, creators, vendors, and app publishers—collectively referred to as "Partners"—who are found or reported to SocialMood to engage in activities within or with countries or individuals designated on relevant sanctions lists.

SocialMood does not accept cash-on-delivery or cash payments and only provide payment methods and collection of business proceeds from bank issued card or wallet individuals and from SWIFT or local bank transfer from businesses through regulated and licensed 3rd party payment providers or local regulated banks.

Despite being a non-regulated e-commerce platform catering to both B2C and B2B segments and not engaged in regulated financial services or third-party money handling, SocialMood voluntarily upholds these standards. We commit to this ethical stance within the best of our knowledge and capabilities, underscored by standard Know Your Business (KYB) practices for record-keeping on business vendors we engage with and industry standard due diligence pertaining to all associated vendors. This practice is a proactive measure to ensure the integrity of our business network, though it is beyond our regulatory requirements.

IV. Operational Integrity in Conflict Regions

SocialMood will refrain from dealing with app partners or vendors that operate in regions recognized as conflict zones by the United Nations Security Council to avoid inadvertently supporting activities that undermine peace, security, and stability.

V. Content and Partnership Restrictions

SocialMood ensures to the best of its knowledge that no content, app publishers, partners and vendors deal with:

  • Prohibited content such as gold and precious metal trading, counterfeit luxury goods, cryptocurrency or open-loop transferrable tokens, weapons, unauthorized pharmaceuticals, pornography, obscenity, human degradation, racism, genocidal acts, incitement, scheduled chemicals, oil & gas reserves.

  • Publishers that conduct campaigns or feature user experiences considered as a game-of-chance rather than a game-of-skill

  • Publishers that facilitate fiat form of cash-payouts as incentives

  • Activities or narratives promoting conspiracy theories.

  • Religious and political services or content which could spur community discord.

VI. Monitoring

To ensure continual adherence to these policies, SocialMood will conduct periodic reviews of vendor and supplier websites. Any variance from compliance will be promptly addressed as soon as it is brought to our attention. Reports of non-compliance may be reported to policy@socialmoodapps.com

VII. Incident Response and Whistleblower Protection

Reports of non-compliance or ethical misconduct can be anonymously filed by any user or staff member. Such incidents are investigated rigorously within seven days, with outcomes reported within 30 days of the claim. Report any claims to policy@socialmoodapps.com

VIII. Dispute Resolution

A dedicated team will handle disputes, ensuring fair and expedient resolutions. Unauthorized reselling or spoofing will be met with strict legal action, including cease and desist orders as necessary.

IX. Staff Trading Restrictions

Employees of SocialMood, including those of AmanaMode Portal Co. L.L.C and its subsidiaries, are forbidden from purchasing SocialMood app’s products for personal use. Stringent detection and prevention measures are in place to enforce this policy.

X. Enhanced Due Diligence on High-Value Transactions

SocialMood applies enhanced due diligence measures on any purchase of vouchers exceeding a value of $100,000.00 USD or its local currency equivalent. Retention of such transaction records will be maintained for up to seven years to ensure traceability and transparency.

Conclusion

Maintaining the highest standards of ethical practice and legal compliance is at the core of SocialMood’s corporate ethos. Through this policy, we commit to being a responsible corporate entity in the digital services landscape.

Review and Update of Policy

This policy will be reviewed annually or as needed to reflect the evolving legal and ethical standards of the industry. All amendments will be communicated efficiently to all SocialMood stakeholders.
